Welcome to Superspeed. We are excited to partner with you in optimizing your store's performance. Please review these Terms of Service, which outline the rules for using our platform and help ensure a secure and reliable experience for all our merchants.

When we refer to “Company”, “we”, “our”, or “us”, we are talking about Superspeed and ApollosWave, LLC.

When we refer to the “Services” or “App”, we mean our comprehensive revenue intelligence platform, designed to help you identify ghost checkouts, track revenue leaks, monitor real-user metrics (RUM), and apply performance optimizations.

By accessing or using our Services, you agree to these Terms of Service. If you have any concerns or do not agree, please do not use the Services.

1. Service Delivery & Expectations

We strive to provide an exceptional revenue intelligence platform. However, to keep our services accessible, the Services are provided "as is" and "as available." Like all software platforms, we cannot offer absolute warranties—whether express, implied, or statutory—including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Every e-commerce store is unique. While our goal is to help you uncover revenue leaks and improve performance, we cannot guarantee specific results, such as exact improvements in site speed, revenue increases, conversion rate spikes, or search engine ranking changes. We also recognize that technology can be unpredictable; therefore, we cannot guarantee the Services will be entirely uninterrupted or error-free at all times.

2. Liability & Scope of Responsibility

As a standard industry practice to protect our ability to operate, the Company and its affiliates will not be held liable for any indirect, incidental, special, consequential, or punitive damages. This includes potential loss of profits, revenue, data, or business interruption that might arise from your use of the Services or any third-party interactions.

Downtime & Custom Optimizations: We work hard to maintain high uptime and offer robust optimizations. However, we are not liable for any temporary service downtime, platform outages, or any issues, conflicts, or unintended side-effects that arise from custom optimizations, theme code alterations, or third-party app incompatibilities on your storefront.

To ensure fairness, our aggregate liability for any claims related to the Services is capped at the total amount you have paid to us during the three (3) months immediately preceding the event, or $100 USD, whichever is less.

3. Mutual Protection & Indemnification

Partnership goes both ways. You agree to defend and indemnify the Company, its team, and affiliates against any claims, liabilities, or expenses (including reasonable legal fees) that arise from your use of the Services, any data you submit, or a violation of these Terms or applicable laws.

4. Account Management

We aim to serve all merchants fairly. However, we reserve the right to suspend or terminate accounts, or refuse access to the Services, at our discretion, without prior notice or liability. We do this primarily to protect the platform and our community from misuse.

5. Platform Evolution

As a cutting-edge revenue intelligence platform, we frequently update our tools to serve you better. We reserve the right to modify, pause, or discontinue features of the Services at any time. We will always try to communicate significant changes, but we are not liable for any modifications or price adjustments.

6. Data Integrity & Security

We employ strong security practices to protect your store's analytics. However, you are ultimately responsible for backing up your store's core data. We are not responsible for any data loss or corruption, nor are we liable for unauthorized access or security breaches outside of our reasonable control.

7. Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which ApollosWave, LLC operates. To resolve disputes efficiently, you and the Company agree that any claims will be handled in an individual capacity, and neither party will participate in a class-action or representative proceeding.

8. Updates to These Terms

We may update these Terms occasionally as our platform grows. Your continued use of the Services after changes are posted means you accept the updated Terms.
